学签到期后继续学习：身份恢复及新学签成功获批
Read in English近日，我们协助处理了一宗较为复杂的学生身份恢复 （Restoration of Status）及新学签申请。
申请人的原学签到期后未及时续签，并在失去学生身份后继续参加高中课程。 之后，他在可以申请恢复身份期限的最后一天， 自行递交了恢复身份及新学签申请。
由于案件涉及未经授权学习（Unauthorized Study）的问题， 申请人在递交申请后找到我们寻求协助。
案件的主要难点
这并不是一宗普通的 Study Permit 申请。
首先，申请人的原学签已经到期， 但他在学签到期后仍然继续参加课程， 因此申请中存在需要正面处理的身份及未经授权学习问题。
其次，申请人是在可以申请恢复身份期限的最后一天， 自行递交了 Restoration of Status 及新的 Study Permit 申请。
同时，他当时新的高中录取安排只有三个月， 从 2026 年 9 月至 11 月， 而且尚未取得加拿大大学的录取通知书。
因此，这个案件不仅需要处理过去的身份问题， 还需要让 IRCC 理解申请人为什么需要继续完成高中课程， 以及高中毕业后的整体学习计划。
我们如何处理这个案件？
接受委托后，我们重新审阅了整个案件， 并在申请已经递交的情况下准备进一步的补充说明及材料。
补充递交重点解释了：
- 学签到期后继续学习的情况；
- 未能及时维持学生身份的背景；
- 目前继续完成高中学业的实际需要；
- 现有高中课程及毕业安排；
- 高中毕业后继续申请加拿大大学的整体学习计划。
对于已经存在的未经授权学习问题， 处理重点并不是回避已经发生的事实， 而是根据申请人的实际情况作出清晰、合理和完整的解释。
最终结果
IRCC 最终批准了申请人的身份恢复及新的 Study Permit。
虽然申请人目前的高中课程预计于 2026 年 11 月结束， 但新 Study Permit 的有效期获批至 2027 年 2 月。
这为申请人完成高中毕业要求， 并准备下一阶段的大学申请提供了额外时间。

这个案例带来的启示
当申请中已经出现身份违规、 未及时延期或未经授权学习等问题时， 这些问题通常不能简单忽略。
更重要的是根据真实情况， 清楚说明问题发生的背景， 同时完整呈现申请人的学习经历、 当前学习需要以及未来学习计划。
对于已经自行递交申请， 但后来发现申请中可能存在身份、 学习记录或其他潜在问题的申请人， 也可以根据案件情况考虑在审理期间 进一步补充解释及相关材料。
本文分享的是个案处理经验。 每个 Restoration 及 Study Permit 案件的事实和风险均可能不同， 过往个案结果并不代表其他申请会获得相同结果。
Study Permit Restoration Approved After Unauthorized Study
We recently assisted with a complex Study Permit Restoration case involving an adult high school student.
The applicant’s previous Study Permit had expired, but he continued attending school after losing his student status. He subsequently submitted his own Restoration of Status and Study Permit application on the final day of his restoration period.
After filing the application, he contacted our office for assistance because of the unauthorized study issue.
Key Challenges
This was not a routine Study Permit application.
The applicant had continued studying after his previous Study Permit expired, creating an unauthorized study issue that needed to be properly addressed.
He had also submitted his Restoration of Status and new Study Permit application himself on the final day of his restoration period.
At the time, his new high school Letter of Acceptance covered only three months, from September to November 2026, and he had not yet received a university admission offer.
The application therefore required not only an explanation of the previous status issue, but also a clear explanation of why the applicant needed to complete his remaining high school studies and how those studies fit into his future education plan.
How We Addressed the Case
We reviewed the application and prepared a supplemental submission while the case was still in process.
The submission addressed:
- The unauthorized studies after the Study Permit expired;
- The circumstances surrounding his failure to maintain status;
- His remaining high school studies;
- His current graduation requirements; and
- His future university study plan.
Rather than avoiding the non-compliance issue, the submission addressed what had occurred and provided context for the applicant’s circumstances and overall study plan.
Successful Result
IRCC approved both his Restoration of Status and his new Study Permit.
Although his current high school program was expected to end in November 2026, his new Study Permit was issued until February 2027.
This provided additional time for him to complete his high school requirements and prepare for the next stage of his university application.

What This Case Illustrates
When an application already involves non-compliance, loss of status or unauthorized study, simply avoiding the issue may not address the concerns raised by the applicant’s immigration history.
It may be important to clearly explain the circumstances, the applicant’s academic background, current educational needs and overall future study plan.
Applicants who have already filed their own immigration application but later identify potential issues may also consider whether further explanation and supporting documentation should be submitted while the application is in process.
